Probably not. Copyright is automatic upon creation. If I recall correctly, registering a copyright is necessary in order to then sue someone to enforce a Hulkamania 44th Anniversary 1976-2020 Signature shirt. So, if Archie copied it for ten years and then Marvel registered the copyright, Marvel could not sue Archie for the ten prior years of infringement but could sue going forward. I get that, but I don't think people would have confused Hulk Hogan with The Incredible Hulk. While both are technically fictional characters, I don't think anyone went to Wrestlemania. Or turned into WWF programming because they thought Bruce Banner would be there.
